You do not have to discuss each of these matters, but you should land on a clear stance in relation to the question.
4. Drawing from one or more criminological theories, make an argument for how the Australian government should approach the problem of online illicit drug sales.
a. Here you will want to link your answer to how you have responded to the question (3) above. For example, if you think online illicit drug markets significantly increase harms to users, how does criminological theory inform your answer as to how such increased harms can best be reduced? You should use at least one criminological theory to support your argument.
QUESTION 2: Raising the age of criminal responsibility
Within Australia and globally there is a growing movement to raise the criminal age of responsibility for young people to 14. In 2019, the UN Committee on the Rights of the Child also issued a recommendation for 14 years as the minimum age for criminal responsibility. To date, no Australian state or territory has made such a change, and only the ACT has introduced legislation to do so. Under current legislation children as young as 10 can be criminally changed in all Australian states and territories.
Write an essay that addresses the following questions:
1. What are the primary evidence-based arguments for raising the age of criminal responsibility to 14? By evidence-based, we mean journal articles, books and book chapters, and grey literature (i.e. governmental reports, conference papers, etc.) that provides evidentiary based support or arguments for why young people younger than 14 should not be held criminally responsible for their actions. It is fine to use one or two media articles, but these will not count towards your required minimum number of scholarly references for the essay (see marking criteria sheet).
2. What are the primary reasons that policymakers in Australian states and territories (with the exception of ACT) have not been amenable to raising the age?
3. If the minimum age is raised, how should Australian states and territories deal with harmful acts by young people?
a. Here you will need to first situate your argument theoretically. For example, what might criminological theory tell us about how to best meet the needs of young people, those they harm, and their communities for young people under 14? You should use at least one criminological theory to support your argument.
b. You might also do some research to support your argument on strategies used by other countries that appear to be effective in meeting the needs of young people, victims, and communities in cases under the age of criminal responsibility.
