This unit describes the skills and knowledge required to within work legal and ethical parameters in professional nursing practice, including supporting rights and meeting duty of care requirements.
This unit applies to enrolled nursing work carried out in consultation and collaboration with registered nurses, and under supervisory arrangements aligned to the Nursing and Midwifery Board of Australia (NMBA) regulatory authority legislative requirements.
The skills in this unit must be applied in accordance with Commonwealth and State/Territory legislation, Australian Standards and industry codes of practice.
Task 1 Written - Knowledge questions
This is the first (1st) of three (3) assessment tasks you need to successfully complete to be deemed competent for the unit.
Task instructions
This assessment will demonstrate your understanding of the skills and knowledge required to work within legal and ethical parameters in professional nursing practice, including supporting rights and meeting duty of care requirements.
You will have your knowledge assessed on information acquired during pre-reading of the PowerPoint’s, reading relevant textbooks, other materials as directed by the teacher and in class discussions, plus any other relevant information provided through your research.
For this assessment, you are to go to SWTAFE Online and complete the knowledge questions. The knowledge questions are self-marking.
Satisfactory completion of this assessment task
For this assessment task, you are required to answer all questions to the standard required to achieve a result of satisfactory.
All assessment tasks must be assessed as satisfactory for you to be deemed competent in this unit.
Assessment conditions
This is an individual assessment task.
You are allocated two (2) attempts to achieve a satisfactory mark.
Knowledge questions should take up to six (6) hours to complete.
This assessment can be completed in allocated class times or during own study times.
Students are permitted to use extra resources to complete the assessment (open book)
Task 2 - Project / Portfolio of evidence – Assessment Project
This is the second (2nd) of three (3) assessment tasks you need to successfully complete to be deemed competent for the unit.
Task instructions
This assessment will demonstrate your understanding of the knowledge required to within work legal and ethical parameters that apply to professional nursing practice. This includes supporting people’s rights and meeting your duty of care requirements. The assessment relates to your current level of knowledge/skills which can be legally/ethically applied in practice during your aged care placement.
You need to choose two (2) situations whilst on your aged care placement. One is to be from a legal perspective and the other from an ethical perspective.
This project has three parts to address and is to be submitted to SWTAFE Online. The word limit for each situation 500 words therefore 1000 words in total for the full assessment.
Part A
Using the legal and regulatory requirements (including Acts, guidelines and frameworks) you will explain how these requirements relate to your nursing practice. You will describe how you complied with the current legislation requirements and identify any implications of non-compliance. Using the Nursing and Midwifery Board Professional Codes and Guidelines you will give details of how you functioned within the scope of jurisdictional requirements for enrolled nurse practice.
Part one is an evidenced based assessment and requires referencing in accordance with Harvard Referencing guidelines. Word limit is 400-500 words.
Part B
Reflecting on the situation during your aged care placement discuss how easy/difficult it was for you to apply your theoretical learning into practice in relation to legal/ethical requirements. What tools, resources etc., did you use to help you with this process?
This is a reflection piece; it does not require Harvard Referencing. Word limit is 100-200 words
Part C Identify the details about all the documentation that was utilised. The documentation must be in accordance with State/Territory legislation and organisation policy and procedures. You will then explain the legal requirements and organisation expectations as to why the documentation was required.
Part three is an evidenced based assessment and requires referencing in accordance with Harvard Referencing guidelines. Word limit is 200-300 words.
Satisfactory completion of this assessment task

Assessment conditions
This is an individual work task and all students must submit their work individually. Aged care placement will be the environment where the students will commence their research relating to this assessment. Students are allocated two (2) attempts to achieve a satisfactory mark.
This assessment can be completed within six (6) hours however this will differ from student to student.
Task 3 Practical demonstration – Clinical placement
This is the third (3rd) of three (3) assessment tasks you need to successfully complete to be deemed competent for the unit.
Task instructions
As a student of the HLT54115 Diploma of Nursing you are required to undertake minimum of 440 hours of clinical placement and to keep a clinical placement logbook. Clinical placement is your opportunity to consolidate the skills and knowledge you have learnt in class and the practical lab on campus whilst demonstrating that you have a commitment to professionalism and the capacity to contribute to safe quality healthcare.
The clinical experience is a major component of the Enrolled-nursing program.
On placement you work towards meeting the Nationally Accredited Framework Competency Standards and the Nursing Midwifery Board of Australia (NMBA) Enrolled Nurse Standards for Practice (2016) and is facilitated by the team of nurse educators at SWTAFE, allocated clinical supervisors and staff from the participating clinical setting. Clinical placement is not designed or set out to either provide or assess job-seeking skills.

To successfully complete this task, you must demonstrate the enrolled nursing standards during clinical placement and be marked at the minimum competency rating (RD: requires development) for the aged care placement.
Assessment conditions
This is an individual assessment task. This assessment task will be completed when your aged care clinical placement is finalised. Please note that it is your responsibility to follow up and ensure all aspects in your clinical placement logbook are marked off during your aged care clinical placement. Also, these placement requirements may also relate to other units in the Diploma of Nursing program.
