The Scenario
You are a chartered surveyor advising your client, Sheffield City Council, on the development of a Grade 2 listed building, currently derelict with structural problems, into 10 one-bedroom apartments, 5 two-bedroom apartments plus a retail unit on the ground floor. The Client has been granted all the necessary planning permissions from the local council. The budget for the works is £3.0m and the contract period is likely to be 15 months.
Your Client has asked you to advise them on a number of issues in order for them to issue a board report to the members to seek approval and subsequently proceed with the scheme.
You must advise your client's director of property by providing answers to the issues stated below.
You must present your advice as a professional concise advisory report including a cover letter. Whilst the questions are primarily concerned with procurement law, you should also include as an ancillary any other aspects (tort, contract and regulatory) that you think relevant to the evaluation of and advising upon the client’s requirements. You are not however required to address planning law matters.
Your report must advise your client on the following issues:
1) Following a discussion with a colleague, the director has been recommended to use the design and build procurement route with a lump sum contract but has asked you to advise them whether this is the most appropriate procurement route for this project or would a traditional form of procurement route be more advisable.
2) Advise the Client by identifying and evaluating the most suitable form of contract to use with your recommended procurement route selected above including a detailed rationale for any amendments to the standard form.
