Several transnational companies, which are major global chocolate producers based in Europe and the US respectively, have been accused of aiding and abetting such exploitation of children by the cocoa farms, because they ‘knew or should have known’ of these practices but nonetheless continued to provide farms with financial support, supplies, and training.

Explain the responsibility and obligations of both states and private actors implicated in these practices under international law. Explain how such obligations are/should be given effect, whether the enslaved children are/should be entitled to sue transnational corporations for damages, and if so, in which countries?
